Q. What services do Siding Claims Services provide?
A.
  • We come to your property and identify the siding on your home.
  • If the siding is involved in an on-going class-action lawsuit, we will handle the claims process for you.
  • We will meet with the third-party inspection representative, if necessary.
  • We will review your settlement to make sure it accurately reflects your damage and that the settlement protocols were correctly interpreted.
  • We handle distribution of settlement proceeds.
  • SCS creates and maintains a database for future and subsequent claims.

Q. How much will it cost to have Siding Claims Services file my claim(s)?
A. SCS charges no up-front fees or out-of-pocket expenses. We work strictly on a contingent fee bases, meaning we get paid only if a client receives a cash recovery. And we receive payment only after your claim has been disbursed to you. All costs and fees are paid out of SCS’s share of the recovery, which protects our clients from paying any additional costs if it becomes necessary to arbitrate or contest a claim.

Q. How long does the entire process take?
A. It will vary slightly from claim to claim, but the entire process may take anywhere from six to nine months. It is a lengthy process and there is nothing that can be done to speed up the process.

Q. What factors may have contributed to my low results?
A.
  • If your house has been painted prior to your inspection, the damage may be covered.
  • Your siding may have little or no qualifying damage at this time.
  • The third-party inspector may not be experienced. The third-party inspection company gives on-site training and classroom lessons to ensure that the inspectors are properly educated about the defective siding. There are also third-party court-appointed auditors that ensure quality inspections.
Q. How much is the average claim?
A. The average price per square foot of defective siding is $4 but the range of prices can range from $3.50 and $5.50 per square foot. There are other factors that have influence on your results such as the age of your home, the amount of siding your home has, and the area where you live.

Q. What if I want to paint my house?
A. SCS recommends that you do not paint your house until you are satisfied with your inspection results. When you have your house painted, the paint covers up most of the damage. Your settlement is based on the amount of visible damage showing so it would be wise to wait. You are still eligible to file a claim if you have painted your house.

Q. Did I receive enough money to completely replace the siding on my home?
A. The settlement amount is usually not enough to replace all your siding. Many property owners will use the settlement they receive as a down payment to replace their defective siding.

Q. Can I recover additional compensation for future damage?
A. Property owners are eligible to file a subsequent claim every year until they receive one hundred percent compensation, until they have their siding replaced or, until their class action lawsuit has ended. For Masonite products, if your property was built between January 1, 1980 and December 31, 1989, you have until January 15, 2005 to file subsequent claims. If your property was built between January 1, 1990 and January 15, 1998, you have until January 15, 2008.

Q. Can I file a claim if I have already replaced my siding?
A. Filing a claim after the siding has been replaced is possible, but much more difficult. The siding must have been replaced prior to May 1, 1999. You must have photographs of the siding before it had been replaced. You must also have invoices and/or a letter from the contractor stating that they did replace the siding.

Q. Why is it important to file a claim for defective siding immediately?
A. All hardboard siding settlements have an expiration deadline. This means that if you wait to file a claim, you may not receive any compensation no matter how extensive the damage to your property. In addition, some siding manufacturer’s class-actions already have expired and others will expire periodically. Plus, if you repair and/or replace your current siding, you run the risk of voiding any claims for compensation, which can cost you literally thousands of dollars. So it’s important to act now.

Q. What do I do if I receive a Payment Confirmation Letter?
A. If you have not received your settlement check, contact our office immediately. The chances are your check may have been returned because of a wrong mailing address, sent to a rental property, lost in the mail or you may have moved. We will put a stop payment on the original check and re-issue a new check. If you are not sure if you received a check we can send you a copy of the cleared check for your records.
